Legal Update On Pensions

As you know, immediately following the passage and Governor Quinn’s signing of SB 1 into law, the IFT pledged to seek justice in the courts.

You may have heard in the news that on Friday, December 27, a group of individuals (through the Illinois Association of School Administrators and the Illinois Retired Teachers Association) filed suit to overturn the new pension law. This is not our lawsuit, but just the first of what will likely be several cases from various groups that oppose this harmful legislation. Of course, the law allows anyone to avail themselves of their legal rights, and our We Are One Illinois union coalition plans to do the same at the appropriate time.

The IFT and our coalition remain focused on preparing to bring the most effective suit possible. We have been actively consulting with our attorneys to develop the best legal strategy to successfully defend your constitutional rights, and those of hundreds of thousands of other public employees and retirees in Illinois.

To that end, our lawyers have reviewed the complaint that has been filed and anticipate that our overall legal strategy will remain the same – to challenge SB 1 as violating the constitution and ask for a stay of the legislation’s implementation pending a court ruling.
